本研究は、現代アメリカにおける政治のイデオロギー的分極化が、司法審査制の運用および理論に与える影響について研究するものである。
本研究の初年度である2021年度は、先行研究の調査と資料収集を中心に研究を進めた。具体的には、特に1970年代以降のアメリカ憲法判例の動きについて、政治におけるイデオロギー的分極化の進行と連関づけて考察した先行研究を調査し、整理と検討を進めた。法学および政治学の研究動向を調査対象とした。また、分極化の下における司法審査制の規範理論および制度構想の動向についても、アメリカにおける近時の研究の調査を進めた。
2021年度の具体的な成果として、中絶分野の近時の判例の動向を扱った論文を公表したことを挙げることができる。中絶は、アメリカにおいて党派的対立が高まっている典型的な争点のひとつである。同論文では、連邦最高裁が2020年6月に下したJune Medical判決を題材にして、中絶分野の判例の展開を追うとともに、現在の法的争点（違憲審査基準等）を整理した。また、各裁判官の行動戦略を分析し、今後の判例の見通しについて考察した。結論として、June Medical判決は、裁判官人事を通じて連邦最高裁が保守派優勢の方向へと移行するなかで、中絶判例のゆくえの不確定性を増幅させた事例として理解すべきであると論じた。同論文は、政治の分極化が憲法判例に与える影響に関する事例研究として位置づけることができる。
以上のような当該年度の研究は、今後の本研究の基礎を構築する意義を有すると考えている。 -

The Japanese parliamentary politics is in a confusion state. Our study is going to research the measures that dissolve and overcome this "confusion state" through a investigation of the intersection of "a dynamic theory" and "a normative theory" about the bicameral system.
A normative theory does predominance in a dynamic theory in Italy and France, and it seems to be tied to an active argument over the system reform in two countries. In contrast, we had an impression that "a dynamic theory" did predominance in U.K., Germany, and Australia. The argument in Japan is placed to the former, but the institutional reforms do not readily advance. -
