    研究２年目にあたる今年度は、スポーツ団体による「権力的」な活動を如何に規律すべきかを明らかにするための一手段として、当該活動の妥当性を事後的に審査するための理論枠組としてどのようなものが考えられるか、検討を行った。
    具体的には第一に、スポーツ団体が選手に対して如何なる「処分」を行う権限を有しているか、「中央競技団体」と呼ばれる団体の規約を横断的に分析した。あわせて、当該処分に対して選手が不服を有している場合、どのような事後救済の手続が確保されているかについても整理を行った。なお、この点については、２０１９年にスポーツ庁が公表した「スポーツ団体ガバナンスコード」の中で如何なる事項が要請され、それが各団体の規約にどのように反映されているかにも着目した。
    第二に、こうしたスポーツ団体による「処分」の事後的な審査の態様が、行政による処分の違法性を審査する場合ののそれと如何なる点で共通し、また異なるかについて、検討を行った。とりわけ学説では、以前よりスポーツ団体による「処分」の妥当性を審査するにあたっては、行政裁量の司法審査に関する議論が参考になることが指摘されてきたものの、具体的な検が必ずしも十分になされてこなかった。そこで今年度は、既存の行政裁量に関する判例を時系列に沿って再度分析し、ドイツをはじめとする外国法の知見も適宜参照しながら、この点についての検討を行った。
    以上の研究成果については、その一部を論文としてまとめ、公表した。
