本研究の目的は、二院制の下での上院の組織のあり方として、「地域代表」的な考慮を行う可能性（あるいは限界）について、その権限との関連にも注意を払いながら、考察するものである。本年度は主たる比較法対象国となる、ドイツの連邦参議院の組織のあり方をめぐる議論を中心に検討を進めた。具体的には、①基本法制定時、②1970年代以降、問題視されるようになった「封鎖政治」の時代（連邦政府とこれを支える連邦議会多数派と、連邦参議院の多数派の間で党派的な食い違いが生じていた時代）、③近年、多党化・分極化が進む中で、各州政府において、連邦政府レベルでの連立とは異なる政党構成から成る連立政権が樹立される事例が増えたことにより、連邦参議院における多数派形成がより困難になりつつある時代、に重点を置いた。①の検討に際しては、基本法の下での連邦参議院が、これに先立つ時代から強い影響を受けてきたことに鑑み、ワイマール憲法の下でのライヒ参議院をめぐる議論等についても、必要に応じて参照した。
また、ドイツと同じく連邦制でありつつも、票数の配分や議員の選出のあり方といった点で現在異なる形態を採用しているアメリカの連邦議会上院を比較対象に加えた。州の代表としての色彩の濃淡という点で違いのある、ドイツの連邦参議院とアメリカの連邦議会上院を比較することは、連邦制をとらない日本の参議院をめぐる「地域代表」の議論を深化させる上でも有意義なものと思われる。
最後に、本研究に関連した判例評釈として、「千葉県議会議員定数配分規定の合法性・合憲性」法学論叢186巻3号（2019年）137頁以下を公表した。本評釈は、直接的には地方議会における定数不均衡の問題を扱ったものであるが、憲法43条1項における「全国民の代表」の問題に関する検討を含むものであり、本研究と密接にかかわるものである。
