The results of this research are the following three points. First, a method for studying the history of child law was proposed based on recent trends in sociology of childhood. Second, in order to investigate the legal background of the enactment of the Child Abuse Prevention Law in 1933, how the nature and purpose of custody was recognized was analyzed. Third, the view of corporal punishment and the logic behind it in pre-war Japan were examined.

本年度は前年度までの研究成果を法制史学会近畿部会第452回例会（2018年5月12日、大阪大学中之島センター）において発表した（「特許法制はいかにして近代日本に根付いたか―特許法執行体制の分析」）。
次いで、前年度に引き続いて近代日本における特許権者の構成や特許権の利用実態について考察を行い論文にまとめた。これは特許活動・技術発展（経済）と特許法制（法）の関係についてとくに個人・法人別の特許権者の特性に着目して分析したものである。日本近代特許法制が資本主義の展開に適応する形で改正され、来るべき技術発展に備えて発明の活用枠組みを与えるものとして機能したことをもって該論文の結論とした。専売特許条例（明治18年）による独占権付与という新手法を採用しての発明保護、明治32年法による外国人特許権・法人特許権の登場およびそれを契機とする特許権を媒介とする技術導入、大正10年法における職務発明規定の整備はいずれもこのように解することができる。ただし、言うまでもなくその活用枠組みを利用できるか否か、あるいは利用するか否かはそれぞれの発明者や企業に委ねられた。実際、特許権を取得したまま苦境を脱し得ない零細発明家や大正期・昭和期に至ってなお職務発明規程を有しない企業がしばしば見受けられる。もっとも、これは特許法制の意義を減却するものではなく、特許法制が用意した発明活用枠組みをもって技術開発体制の成長期を見据えてやや大きめの衣服を着せたものと評価することはできよう。戦前期日本の産業技術の動向を技術後進国ながら概して順調な発展を遂げたものと見るならば、その一翼を担ったのは以上のような発明保護法制であった。なお、該論文は法制史学会70周年記念若手論集への投稿を予定している。
