    4年計画の初年度にあたった2019年度においては、まず問題状況の整理と基礎的な資料の収集に集中することとなった。そもそも本研究課題の契機となったのが2018年秋の日本学生支援機構による保証人への全額請求問題（分別の利益不告知）であったため、同問題のその後の議論状況及び保証に関する資料の収集が研究の前提として必要であったからである。
    この過程において、保証に関する資料の収集にはそれほど困らなかった。我が国においてこれまでに豊富な議論の蓄積があったからである。それに対して、分別の利益に関する資料の収集は思いの外に苦労した。条文上、共同保証人の負担について定める民法456条が、複数当事者の債権債務関係について定める民法427条を準用するという形式を採用している。明文で定められている制度であるため、起草以来、一定の議論が積み重ねられているものと思っていた。しかし、義務負担者が複数存在するならば、その者達の間で負担を分割するという発想がシンプルであるためなのか、細かな点まで含めて検討されているようには思われなかったのである。分別の利益について必ずしも十分な議論がなされていないことについては、他の専門家らが日本学生支援機構の件を論じる中でも指摘されるようになってきており、私の認識で正しいようであることがわかっている。
    ただ、検討すべきポイントを明らかにできたという意味で、4年計画の初年度としては十分に議論を整理できたと考えている。具体的には、①分別の利益が抗弁であることの由来、②民法456条が民法427条を準用するという形式を採用した際の議論、③各求償関係といった諸点である。次年度以降においてはこれらの点を中心に研究を進める。

    The rules of the Civil Code in the case of rights and obligations to multiple parties have two respects. - "guarantees" and "devolvements." It is important to research these elements at the same time, but, "devolvements" are depreciated. So, in particular to take the subject of comparative law the French law there is an accumulation of research on the "format" , and then, this structural analysis is done.
