In a situation where medical costs are increasing due to population aging and the advancement of medical technology, the research question of this study is to examine the medical and nursing care delivery systems in Japan, Germany, France, South Korea, the United Kingdom, and Australia, focusing on facilities.
It is a seemingly contradictory policy to guarantee the quality of medical care and ensure access to medical care while restraining medical costs. However, medical issues that are closely related to life and health should not be linked to reducing the quality and quantity of services to control costs. In this regard, we have been examining what issues each country is facing and what measures they are taking. The result is “World Hospitals and Nursing Homes,” edited by Tomoyuki Kato (Horitsu Bunka Sha, March 2020). -

Through this study, we could understand it was common all over the world that the medical treatment fees system didn't adopt the cost accounting system. And we got the idea that Japanese medical treatment fees system was very precise and have structural uniformity. On the other hand, we often/always use medical treatment fees system for controlling medical facilities and can say the way of control weights on such a system without well-balanced. We are to share a hypothesis that it's difficult to make a scrap and build of medical facilities under too much emphasis on medical treatment fees.
Basing of this hypothesis, we shifted this study from Scientific Research (B) to Scientific Research (A). Under Scientific Research A, we are make researching on Medical system in general including medical facilities. -

I studied "liaison" from the self-support system on daily life to the advocacy system(the Guardianship and Administration), especially the roles and regal issues of community social welfare council in 2009. In 2010 I researched the prevention of abuse for elderly people, handicapped persons and children. In2011 I mainly studied complaint procedure and its legal problems.
Through this research, I could get valuable achievements for issues and some method of settlement about powers and roles of statutory advocacy organizations. -

The social and economic environment where original and traditional social insurance schemes in the European countries were instituted has changed a great deal in the past few decades due to factors such as change of demographic structure, variation of labor market, diversity of marriage, family and life styles.
In order to cope with those changes, social insurance systems have been reformed, especially among the developed welfare states in Western Europe. For example, the discrimination between part time workers and full time workers in social insurance legislation has been eliminated and the sex discrimination in the social insurance entitlement has been prohibited in the EU as well. Furthermore, the financing of social insurance has been partly funded by various taxes even among the Bismarck model states such as Germany and France.
These reforms have brought about the revision of the traditional tool concepts contained in social insurance legislation, such as the concept of the employee, the self-employed, the family dependent and the employer-employee contribution system.
On the other hand, some European states have pushed on with Welfare to Work policy under the fundamental idea of the Third Way, which has some relationship with social insurance reforms.
In this research, it has been made clear that 1) what parts of traditional tool concepts have been revised, 2) what policy framework should be recognized in the trinity concept (opportunity, responsibility and community) that composes the fundamental idea of the Third Way, and 3) what relationship between social insurance reforms and the Third Way policy framework in the European welfare states may exist. -
社会保障法領域における中間組織の研究-比較法による第三者型権利擁護活動の検討

本研究課題遂行に当たっての平成18年度の具体的な研究活動は以下の通りである。
1.社会福祉協議会による法人後見業務実施に当たっての検討課題の抽出と検討。
2.福祉サービスをめぐる苦情・紛争の解決における第三者型専門家ネットワークの構築と展開。
3.社会福祉法人職員自身による権利擁護のあり方。
1について
都道府県社会福祉協議会は、社会福祉法に基づき、地域福祉権利擁護事業(福祉サービス利用援助事業)の実施が義務付けられているところであるが、当該事業利用者が加齢等とともに、当該事業でカバーしうる状態を超え、成年後見制度への移行が必要なケースが出てきている。ところが、成年後見制度が身上看護をも業務内容としているとはいえ、もっぱら財産管理に力点が置かれているため、特に低所得者層を中心に移行が困難な状況にある。身上看護を中心とする成年後見人等の担い手が不足している現状において、社協の社会的役割から積極的な法人後見が求められる。しかしながら、社協が事業として実施するにあたり、受任対象範囲、マンパワー、利益相反、都道府県社協と市町村社協の役割分担等の多様な検討課題が浮き彫りとなった。18年度は、これらの課題に関して、岡山県社会福祉協議会の協力を得て、岡山県の状況をベースとする結論を得た。本研究で得られた成果をもとに、全国の社協の状況をつぶさに比較検討して、立法政策提言に発展させることを次のステップとしたい。

岡山大学において職能団体の制約を受けない形で、弁護士、司法書士、医師、看護師、社会福祉士等が個人加入する専門家ネットワークを形成し、それによる権利擁護活動の実践に至ることができた。特に、専門家ネットワークを基盤に「医療・福祉リーガルリスク予防研究センター」を設置し、大学主体の中間組織の立ち上げを行った。10月には「医療・福祉におけるリーガルリスクの予防と解決の将来像-専門職の連携と協働-」と題するシンポジウムのシンポジウム司会を務め、医療関係トラブルをめぐる権利擁護のあり方について討議し、本研究推進の一助とするとともに、本研究での知見を生かした意見交換を行った。
3について
個人情報保護を素材に、社会福祉法人職員のコンプライアンスおよびリスクマネジメント活動と権利擁護の関係性を検討した。
