研究初年度に当たる本年度は、Aグループ（国家法間の調整の観点からのアプローチ）を中心に、各メンバーによる相互報告により、問題意識の共有を図ると共に、有識者との意見交換により情報収集を行った。
前者については、グローバル・デジタルプラットフォームガバナンス研究会（GDPG研究会）を立ち上げ、7月、10月、1月に各3時間、オンラインで開催し、毎回3名、合計9名のメンバーが夫々研究課題に関する報告を行った。また、後者については、千葉恵美子教授（大阪大学）とプラットフォームビジネス公開研究会を共同で月1回のペースで開催し、有識者の報告に基づき議論した。これらの作業を通じて、各法分野において、とりわけ国家管轄権理論についての理解、及び、デジタルプラットフォームをどのような性質のものと理解しているかという点に相違があることが確認された。
また、本年度は、今後の共同研究発展のための組織作りも行った。すなわち、技術補佐員を雇用して事務局を立ち上げると共に、本研究についてのウェブサイトを作成し、今後の情報発信のための基盤を作った（https://gdpg.law.nagoya-u.ac.jp/）。
尚、研究成果の一部は既に初年度から各メンバーにより公表されている。その中でも、本研究の問題意識を示した横溝「抵触法の観点からのデジタルプラットフォーム研究－その課題と学際的研究の必要性について」法律時報93巻12号、及び、Japanese Yearbook of International Law 64巻（2021）の特集Cross-border Aspects of Conducting Business Activities Through Digital Platformsにおける原田・渕・横溝の論稿をここでは挙げておく。 -

本研究課題は、NewSpaceと呼ばれる宇宙産業の構造変化のなかで現れてきたさまざまな法的課題について、複数の法領域の研究者が共同して、総合的かつ多角的な観点から検討を加えることを目的とするものである。2021年度は、各自の個別研究のほか、年度中に３回の研究会を実施し、研究報告やゲストスピーカーによる講演を実施した。研究の成果は、雑誌論文等のほか、代表的な学会等（第65回宇宙科学技術連合講演会、第67回日本空法学会、第13回宇宙法シンポジウム）において公表されている。
第1回研究会（2021年8月開催）では、2019年に国内の宇宙活動法を整備したアラブ首長国連邦（UAE）で活躍する弁護士をゲストスピーカーとして招聘し、オンラインで講演を実施していただいた。講演では、UAE宇宙法の紹介のほか、UAEにおける産業振興政策やビジネスサイドの受け止め方について詳細に教示していただいた。第3回研究会（2022年3月開催）では、宇宙デブリ・サステナビリティ格付け制度（SSR）について、制度作りに参画されている国内の専門家を招聘し、意見交換を実施した。
2021年度は、国際宇宙ステーション（ISS）や国際電気通信衛星機構（旧インテルサット）の民営化というひとつのテーマについて、国際法、民事法、行政法の研究者が、国際公役務や民営化の手法というそれぞれの観点から分析検討を行うことができ、分野を超えて共同研究を実施するという本研究課題の意義を感じた1年であった。 -
海事債権の実現方法に関する比較法的研究―船舶先取特権制度の再検討を中心として

本研究は，船舶の運航に伴って生じる様々な債権の実現のために利用される日本法上の諸制度，特に，実務上よく利用される船舶先取特権制度について，主要国の同様の機能を有する制度と比較検討し，機能面に着目して分析しようとするものである．
初年度にあたる2019年度は，研究環境の整備，文献の収集・分析，研究会等への参加による情報収集を進めた．イングランド法に関しては，船舶のアレストに関する文献の分析に加え，これに関連しうるその他の諸制度の検討も行った．また，研究会等への参加を通じて，近隣国における海事倒産法制や，海事裁判所ないし裁判所への海事専門部の設置に関する動向等も知ることができた．当初は，初年度中に，イングランドの対物訴訟制度等と日本法の関連する諸制度との対比・分析を完了する予定であったが，社会情勢の変化に伴い，分析対象の切り取り方と考察を見直す必要が生じたため，成果としての取りまとめは遅れている．
以上の核心的な部分の検討に加え，船舶ファイナンスの重要な一要素となっている定期傭船契約について，わが国の判例を検討する機会を得たので，イングランド法と対比しつつ検討を行った．2019年度の成果としては，準拠法決定に係る部分に絞って検討した判例評釈を1件公表した．定期傭船契約はイングランド法の影響を強く受けた契約書式が国内取引においても広く利用されている領域であるが，イングランド法と日本法では，燃料油の所有権やその代金債権の担保のあり方についての考え方は相当に異なっており，この点は本研究の核心的な部分と強く関連する．このため，定期傭船契約に関する日本法の現状整理は，本研究課題の成果の一部としてとりまとめることを考えている． -

自律航行船等による運航、極域航行の各々について下記の検討を行った。
(a)自律航行船等による運航 前年度の検討に引き続き、既存の海事法制に含まれるルール（特に国際条約及びそれに基づく基準等を中心に）のうち、船舶の航行が船員による操船を前提としなくなることで直接影響を受けるものにつきどのような内容の手当てがあり得るかを検討した。その際に、(i)公法的規律（たとえば船舶の安全性をめぐる公法的規制及び海上衝突予防規則（COLREGS）の適用）と、(ii)私法的規律（船舶衝突条約上の過失の扱い、油濁損害における民事責任条約の責任集中の適用のあり方、堪航能力担保義務の内容、船主責任制限制度の適用等）とに分けて検討を進めた。条文適用上の問題点に関してはほぼ結論が出たものの、政策的な問題（遠隔操作者にどこまで責任を負わせるか）については、さらに検討すべき課題が少なくないことが分かった。
(b)極域航行 前年度の検討により明らかになった、現在の極域航行の実態や将来の見込みを前提として、既存の海事法制に含まれるルールにつき、国際条約及びそれに基づく基準等を中心に網羅的に調査し、商業航海による海洋汚染事故についての民事責任、衝突事故を防止するための航法、極域固有の堪航能力担保義務の内容、極海域へのクルーズ船の増加に伴う法律問題等について、北極海独自の規律（立法及び解釈・運用を含む）を導入する必要があるか 、仮に必要だとするとどのような内容のものとすることが望ましいかを明らかにした。個別のルールの検討については、かなり深度のある検討ができたが、海事法の基礎理論へのフィードバックが今後の課題として残ることが分かった。 -

The aim of this study is to analyze and consider that national cultures influence the formation of soft law in business practices. Specifically,we have examined trade documents such as S-BL, SWB, and E-SBL to understand the above-mentioned topic. Our research is both theoretical and empirical,and has conducted that global business communication, business negotiation, business customs, and ADR.

This aim of this study is to verify a hypothesis that soft law (business practices) and hard law (legal system) coevolve by influencing each other.
By focusing on new transport documents used in international transactions such as e-SWB, e-surrender B/L and sea waybill, the study analyzes how the use of those documents influences the formation of legal systems and how systems influence business practices. Through theoretical and factual analysis, the study concludes that business practices and legal systems coevolve by influencing each other. -
