    Skin sensitization is an allergic reaction caused by certain chemical substances, and is an important factor to be taken into consideration when evaluating the safety of numerous types of products. Although animal testing has long been used to evaluate skin sensitization, the recent trend to regulate such testing has led to the development and use of alternative methods. Skin sensitization reactions are summarized in the form of an adverse outcome pathway consisting of four key events (KE), including covalent binding to skin proteins (KE1), keratinocyte activation (KE2), and dendritic cell activation (KE3). Equivalent alternative methods have been developed for KE1 to KE3, but no valid alternative has yet been developed for the evaluation of KE4 and T-cell activation. Current alternative methods rely on data from KE1 to KE3 to predict the effect of chemicals on skin sensitization. The addition of KE4 data is expected to improve the accuracy and reproducibility of such predictions. The aim of this study was to establish an assay to evaluate KE4 T-cell activation to supplement data on skin sensitization related to KE4. To evaluate T-cell activation, the Jurkat T-cell line stably expressing luciferase downstream of the pro-inflammatory cytokine interleukin-2 promoter was used. After exposure to known skin sensitizing agents and control substances, luciferase activity measurements revealed that this assay was valid for evaluating skin sensitization. However, two skin sensitizers known to have immunosuppressive effects on T-cells reacted negatively in this assay. The results revealed that this assay simultaneously allows for monitoring of the skin sensitization and immuno-suppressiveness of chemical substances and supplements KE4 T-cell activation data, and may thus contribute to reducing the use of animal experiments.

    Advance directives are statements made beforehand by a person who was competent at the time about the care he/she wishes to receive if he/she were to become incompetent in the future. They are thus means of determining the patient's will when surrogate decision-making is needed. However, difficult problems may arise if advance directives conflict with the interests of the patient as judged by the people around him/her. This paper will explore this issue, focusing on advance directives of dementia patients. Theorists have varying opinions on the advance directives provided by dementia patients when they were competent. R. Dworkin argues that if someone has made a prior expression that "I will refuse any medical treatment at the terminal stage of dementia", we should not give the person any treatment at all. In contrast, R. Dresser asserts that "a dementia patient is a 'different person' from the person who made the advance directive", so that advance directives should be overridden if the current benefits of treatment the dementia patient may obtain are greater than the burden resulting from it. M. Quante asserts that advance directives should be respected as long as they do not cause actual pain or harm to dementia patients. The differences between these assertions are, in my view, based on differing views regarding the "personality" of incompetent dementia patients. Dementia patients have lost their personalities, according to Dworkin and Quante, while they have a "different personality" according to Dresser. However, a dementia patient and the person he/she used to be cannot be completely severed, for he/she is a being who lives one human life. Therefore, in order to make decisions on behalf of the patient, I suggest the need to distinguish him/her from the person who he/she used to be while at the same time regarding him/her as a person who lives one human life.

    本年度は、対応能力を欠くと判断される人にとっての「最善の利益」の構成要素を検討するために、１．対応能力を欠く人の自律尊重に関する考察、２．対応能力を欠く人にとっての「利益」概念の精査という2つの側面から研究を遂行した。
    具体的には、１については、特に認知症患者の事前指示の有効性に関する議論や、自律的意思決定とアドバンス・ケア・プランニング(ACP)の意義と課題をめぐる議論を検討した。これにより、ACPにおける意思決定の課題を検討するとともに、対応能力を有する時点での自律的意思決定や価値や選好が、対応能力を欠く状態の本人の意思決定においてどのような重要性を持ち得るかを考察した。
    ２については、対応能力を欠く人にとっての現在の利益に関する先行研究の議論をサーベイし、身体的・経験的利益を重視する理論と、選好や価値を重視する理論の比較検討を進めた。これにより、先行研究の議論において、本人が保持する能力・機能の程度に応じて、本人にとっての利益と判断されるものの意味内容が異なり得ること、また、医学的に判断される最善よりも本人の選好や価値を優先する程度が異なり得ることが把握された。このことからさらに、それらの議論の前提となっている理論的根拠を精査する必要性が課題として明確にされた。これらの文献研究と並行して、対応能力を欠く人のケアに携わる家族や専門職者などとの意見交換を継続的に行った。これを通して、対応能力を欠く人の意思決定における自律尊重の現実的な課題と、本人の利益の捉え方に関する情報収集を進めた。
