This research clarified in part the significance of rhetoric in the tradition of republican thought. For that aim to achieve, I collected a pile of primary and secondary materials on the ancient Roman writers, such as Cicero, Sallust, Livy and Tacitus, in libraries from home and abroad, studied their works through consulting the secondary materials on them, which were published by D. Kapust or G. Remer, and found their conception of the relation between rhetoric and the republic. As some achievements, I published two of serial articles, Rhetoric and the Republic in Okayama Law Journal (1) vol.66 No.2 (2016) (2) vol.67 No.2 (2017), and reported in the seminar at Faculty of Law, Seikei University on January 2018.

法的枠組みの公共的正統化理論の構築

本研究は三年計画で進められたが、今年度の研究は、その最終年に当たり、これまでの研究実績のいわば集大成として位置づけられる。今年度の研究は、前年度で講読・検討した榛々な政治哲学の議論を法理論へ接合し、また憲法理論系の理論的功績を法理論に一般化すること、そしてそれを通して、これまでの研究をまとめ、法的枠組みの公共的正統化の理論モデルを提示することにあった。以上の計画を実施するに当たり、以下の研究作業に当たった。
まず昨年度に引き続き、審議的デモクラシーの論者達の著書や論文を購読し、政治的審議から法が生成する過程についての考察を深めた。また他方で、共和主義的立憲主義の論者達の著書や論文を対象にして、憲法と政治過程の関連を考察し、広く法と政治との関係として再定式化する可能性を模索した。具体的には、初年度に提起した暫定的結論(「法と政治とが循環的関係にある」)を、以上の文献をもとに再度検証し、制度圏と非制度圏、国家と市民社会などとの関係をも含め、拡張ないし深化することに努めた。一言でまとめるのは難しいが、制度圏=国家における法的枠組みが、非制度圏=市民社会における政治的審議に対して、権利保障や参加資格付与を通して一定の歯止めをかけ、逆に前者が後者を通して生成ないし公共的に正統化されるような循環的プロセス・モデルを提起したのである(詳しくは、拙著202-231頁を参照)。以上の考察が、本研究の最終的な目的(共和主義の思想蓄積をもとに、法的枠組みの公共的正統化の理論を構築すること)に対する、一応の結論であると考える。
以上の研究成果は、今年度公刊した著書『共和主義の法理論 公私分離から審議的デモクラシーへ』(勁草書房)にて公表することができた。これは平成16年度以降の科研費による研究成果である。
