本研究課題は、これまで調停手続において周縁化されてきた紛争当事者の感情的側面に焦点を当て、非暴力コミュニケーションによる感情のケアと対立解消のための技法を取り入れて、情動解消に対する支援を調停手続の中に積極的に組み入れた新しい調停モデルの開発を目的とするものである。日本において交渉促進型調停として紹介・実践されている調停手続は、当事者間の関係を維持した状態での紛争解決に長けているものの、当事者間の水平的な対話を重視する方法として機能するには、当事者が相手方と建設的に対話するために不可欠な情動のケアが不十分であるために、当事者間の直接交渉回復の支援が十分に実現されていない。そこで研究に際しては、日本において交渉促進型調停として紹介・実践されている調停技法に関する研究を批判的に分析し、当事者の情動が手続から疎外される要因を明らかにするとともに、感情的側面から当事者間の対立解消を目指す非暴力コミュニケーションの技法と価値観を既存の調停技法に融合させる方法を模索する。
初年度である2021年度は、基礎資料の収集等を行うとともに、既存の交渉促進型調停の理論・技法に関する日本での研究の調査・分析を中心に行い、交渉促進型調停の理論・技法の理念や目指す解決の方向とこれらの実践に対する批判的研究について整理・検討を行った。また、当初は2022年度より開始予定だった非暴力コミュニケーションに関する調査を2021年度後半より開始し、2022年度以降の研究の基礎を整えた。 -

The aim of this study is to consider proper ways and means for consumers who are not expected to exercise their own rights from a cost-effectiveness perspective to participate in the proceedings of collective litigation in Japan. As a result of reviewing the consumer class actions in the United States and a new law for consumer collective litigation in Japan, the necessity was found out to provide for consumers enough information regarding the proceedings, based on which consumers monitor the proceedings regularly and make decisions on exercising their rights.
